Welcome to Tow Assistant (“Company”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website https://towassistant.ai products, services, booking system, platform, downloadable content, AI voice & chat assistants, and SMS communications features (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms.

A credit card is required to secure all appointments. Appointments are confirmed via email/text.

USE OF SERVICE:

Tow Assistant offers AI-driven solutions, consulting, and marketing automation, including:

  • Booking consultations

  • AI voice agent communications

  • SMS appointment reminders and updates

  • Informational or promotional text messages (if opted in)

CONSENT TO SMS MESSAGING AND AI COMMUNICATION

By submitting your phone number through a form, calendar, or website page, and checking the consent box (where applicable), you agree to receive SMS or AI voice communications from Tow Assistant:

  • AI voice calls and/or pre-recorded messages SMS or MMS messages

  • Message frequency may vary. Standard message and data rates may apply

  • You represent that you are the owner or authorized user of the mobile number you provide and that you are authorized to consent to communications

OPT-IN & OPT-OUT

You will receive SMS communications after providing consent via:

  • A website form or booking calendar checkbox

  • Verbal or written (if applicable)

You can opt out anytime by replying STOP to any message. To request help, reply HELP or contact or help desk at [email protected].

After opting out, you will receive a confirmation message and no further messages unless you opt back in.

USER RESPONSIBILTIES

You agree not to:

  • Use our Services for unlawful or fraudulent activity

  • Interfere with our systems or impersonate others

  • Enroll others' phone numbers without their permission

RIGHT TO REFUSE SERVICE:

We reserve the right to refuse service to anyone for any reason.

SERVICE GUARANTEE (Redo Policy):

We strive for perfection. If you are unsatisfied, please contact us within 7 days of your service. While we do not offer refunds on services, we are happy to schedule a correction appointment.

CONSULTATIONS:

All services begin with a thorough consultation—the most important part of the experience. We make every effort to listen and discuss exactly what our guest are expecting. As wishes are discussed, we ask our guests to voice any issues or concerns—we’re here for you and want you to be satisfied. Our service providers will also offer product recommendations, as well as discuss routine maintenance. Before the services are rendered, our team will discuss the process as well as the products that will be used. We will do our best to provide accurate pricing estimates and timing on delivery. Please understand some service requests will take longer than others an may require multiple consultations.

DATA HANDLING & SHARING

We respect your privacy. By using our Services, you agree to our data practices outlined in our Privacy Policy.

We do not share or sell your mobile number, SMS opt-in, or any other information for marketing purposes. Your Opt-in data is only used to deliver messages via our trusted messaging service providers.

Program and Carrier Disclosures:

  • Program Name.

  • Allergic Reactions: Risks of skin irritation or allergies from hair dye products.

  • Color Results: Acknowledgment that desired results may require multiple sessions, especially when lifting dark hair, and that the final color may vary.

REFUND & CANCELLATION POLICY:

1. Subscription Cancellations

You may cancel your AI Employee subscription at any time via your Account Settings or by emailing the help desk at [email protected]

  • Monthly Plans: Cancellation stops the next billing cycle. You will retain access to your AI Employee until the end of your current paid period.

  • Notice Period: To avoid being charged for the next cycle, please cancel at least 48 hours before your renewal date.

2. Yearly Commitment & Annual Plans

To offer significant discounts on annual plans, we commit server resources in advance.

  • 7-Day "Grace Period": New annual subscribers may request a full refund within 7 days of purchase, provided the AI Employee has not completed more than 20 automated tasks

  • Non-Refundable After 7 Days: After this window, annual plans are strictly non-refundable.

  • Early Termination: If you must cancel mid-year, no cash refund is provided; however, we may issue an Account Credit for 50% of the remaining value, usable for future "re-hiring" or other services. 

3. Refund Eligibility (The "14-Day/Low-Usage" Rule)

Because AI agents incur immediate server and compute costs upon activation, refunds are only granted under the following conditions:

  • Timeframe: The request is made within 14 days of your initial purchase.

  • Usage Limit: Your AI Employee has performed fewer than 20 tasks/interactions or consumed less than 5% of your monthly credit allotment.

  • Renewals: Automatic monthly and yearly renewals are non-refundable. We send a reminder emails 3 days before annual renewals to allow for cancellation.

  • Access After Cancellation: If a refund is processed, access to the AI Employee and our services is immediately revoked.

4. Non-Refundable Items

The following fees are strictly non-refundable once work has commenced:

  • Custom Training Fees: Any one-time fees paid for "fine-tuning" the AI on your specific company data.

  • Setup/Onboarding Fees: Human-assisted configuration or API integration services.

  • Partial Months: We do not offer prorated refunds for unused days within a billing cycle.

5. Service Failures & Technical Issues

If a technical bug prevents the AI Employee from performing its core functions for more than 24 consecutive hours, you may be eligible for a pro-rated credit or refund for the downtime. This does not apply to "hallucinations" or AI output quality, as these are inherent to LLM technology.

6. Technical SLA & Service Failures

  • Eligibility: A pro-rated refund or credit is only triggered if a verified system-wide outage prevents the AI from performing its core functions for more than 24 consecutive hours AppCost.AI.

  • Exclusions: Downtime caused by third-party API providers (e.g., OpenAI, Anthropic) or user-side integration errors is not eligible for refunds.

7. Abuse & Fraud Prevention

  • Repeated Requests: We reserve the right to deny any refund request from accounts with a history of more than two successful refunds Metaverse Labs.

  • Chargeback Policy: Initiating a chargeback without first contacting our support team will result in immediate account termination and forfeiture of all stored data Create Powerful AI. 

8. How to Request a Refund

To request a review, email [email protected] with:

  1. Subject: Refund Request - [Order #]

  2. Reason: A brief explanation of why the service didn't meet your needs.
    Approved refunds are processed to the original payment method within 5–10 business days.

"AI Output" Disclaimer

  • Quality & Hallucinations: We do not offer refunds based on the "quality," "style," or "accuracy" of AI outputs (e.g., hallucinations). The user acknowledges that AI is probabilistic and must be monitored by a human supervisor.

  • Performance Extensions: In lieu of a refund for dissatisfaction, we may offer a "Value-add Extension", adding 30 days of free service or a free optimization session to help retrain your AI agent.
